The Caldor Fire was one of the most devastating wildfires in Northern California’s history. According to KCRA3, the fire was started when a projectile was launched from a gun, hitting a tree, thus leading to a fire that spread 346 square miles before being extinguished. That’s a certified American moment right there. Over one thousand buildings were destroyed, and the Sierra-At-Tahoe ski resort was severely damaged by the wildfire.
The Tahoe Daily Tribune reports that David Smith and Travis Smith will be making a preliminary examination appearance in Placerville court on October 11th. They are facing several charges, with each of them facing three felonies. Travis Smith is facing two more felonies: “one each for possession of a silencer and a machine gun conversion.” David Smith is facing an additional felony charge for having a silencer.
The preliminary hearing is described by the Department of Justice as a mini-trial. Witnesses are called by the prosecution for testimony, and the defense can cross-examine them. Evidence can also be introduced by the prosecution. The preliminary trial is for a judge to determine whether the probable cause can be found in a criminal trial. If the judge approves a trial will begin. If not, the charges against the defendant could be dismissed. Based on the circumstances, this looks like it will be heading to a criminal trial.
